Trademark Overview
As stipulated by the Trademark Law of the People’s Republic of China, any natural person, legal person or other organization that needs to obtain the exclusive right to use a trademark for its goods or services in production and business operations shall file an application for trademark registration with the Trademark Office.
China is a member of the Madrid System for the International Registration of Marks. Apart from submitting domestic trademark registration applications directly to the Trademark Office, applicants may also file international trademark registration applications via the Madrid System.
Any sign capable of distinguishing the goods of one natural person, legal person or other organization from those of others is eligible for trademark registration application, including words, devices, letters, numerals, three-dimensional signs, combinations of colours, sounds, as well as any combinations of the aforesaid elements.
Where a registered trademark has not been put into continuous use for three consecutive years after registration, any third party is entitled to apply to cancel the trademark registration.
